New article "The change from bankruptcy proceedings to composition proceedings after the opening of bankruptcy proceedings" in 'Aktuelle Juristische Praxis (AJP/PJA)'
MLaw Kim Nguyen, a trainee at Wicki Partners AG, co-authored the article "Der Wechsel vom Konkursverfahren in ein Nachlassverfahren nach der Konkurseröffnung - Sanieren, was saniert werden kann" (The change from bankruptcy proceedings to composition proceedings after the opening of bankruptcy - reorganising what can be reorganised), which will be published in the October issue of Aktuelle Juristische Praxis (AJP/PJA).
The article describes the initial situation of an insolvent company that does not file a petition for a moratorium at the same time as it files for bankruptcy. If the conditions for reorganisation proceedings are nevertheless met, it is no longer possible to switch from bankruptcy to composition proceedings. Such cases are not uncommon in practice. The article describes proposed solutions in the interest of the economy as a whole for companies that are actually capable of survival and reorganisation.
